3. If the BUYER is unable to recieve the bird/s then SELLER, at his/her sole discretion, may either consider the BUYER's order canceled, and retain any payments made and sell the bird to the next available customer or may renegotiate a delivery time with the BUYER for the bird, this is at OASIS EXOTIC BIRDS, LLC sole discretion .....5. SELLER warrants that, at the time of delivery, the birds herein referenced are in good health, free of Congenital Defect/serious birth defects. BUYER is REQUIRED (to validate this guarantee) to have the birds examined by a veterinarian of his/her choice within seven (7) days from the time of delivery (including shipping time) to verify the health of the birds.

4. If, during this 7 day period the birds dies, cause of death resulting from Congenital Birth Defect,or it is found upon initial vet exam to have a serious life threatening congenital birth defect determined by the examining AVIAN Veterinarian, then upon verification of this condition to SELLER (in writing, either health exam or post mortem exam of the bird/s) at BUYERS expense.  SELLER agrees, at his/her sole discretion, to provide the BUYER with another bird or birds of the same species, sex (if available/applicable),currently available or from a future clutch. However, any negligence on the part of the owner/others, including but not limited to:

Not providing proper diet, caging, exercise, psychological stimulation, proper training for the bird once in their care.  Injury (either accidental or intentional) or failure to seek prompt medical care and testing by a licensed avian veterinarian nulifies this guarantee.

5. Cost incurred from return and re-delivery transportation of said bird/s , if bird is to be shipped to be borne by BUYER. It is hereby understood that, prior to receipt of another bird under this paragraph, BUYER and SELLER shall execute a new Sales Agreement referencing the new bird prior to its delivery to BUYER.

6. In the event BUYER fails to have the birds herein referenced examined by a veterinarian within seven (7) days after delivery of bird/s to buyer, then BUYER understands and agrees that the sale is one of as is condition. There will be no warranty/guarantee either written or implied. BUYER understands and agrees that seven (7) days from delivery of the birds to BUYER, commencing when bird/s leave our possession, all warranties of health, fitness, merchantability and personality trait and pet potential, whether express or implied by law, are hereby expressly and voluntarily waived by BUYER. All risk as to the quality and/or performance of the birds referenced herein is with the BUYER and BUYER assumes all risk and cost of injury, death and treatment for the birds once said bird/s is in the BUYER'S possession. OASIS EXOTIC BIRDS, LLC  & it's affiliates and/or partners assume NO liability for the bird once possession of the bird has been completed by Buyer. 
7. We retain the right to refuse the sale to anyone for any reason & in the event SELLER is unable or unwilling to deliver the birds to BUYER for any reason SELLER agrees to refund money paid (except deposit), to BUYER within 30 days of SELLER 's decision to not deliver the birds.

We reserve the right to refuse to sell any bird to any individual, for any reason.

8. Regardless of the conditions and circumstances surrounding the negotiation of this Sales Agreement, BUYER and SELLER agree that the interpretation and enforcement of this Agreement shall be governed by the laws of the State of Illinois in which state OASIS EXOTIC BIRDS, LLC resides and any suit instituted by BUYER or SELLER to enforce any term, condition or clause of this Agreement shall be filed in the appropriate Court in the County of St. Clair, in the State of Illinois.
9. In the event that either party hereto must file suit, as referenced in paragraph #8, to enforce the terms of this Agreement, it is agreed that the prevailing party shall recover all costs, including attorney's fees, associated with said enforcement from the losing party.
10. This Agreement has been read and understood by both parties hereto, and by executing the Agreement, with signatures, of both the Buyer & the Seller, both parties agree that all terms and conditions contained herein are acceptable and legally binding.
11. OASIS EXOTIC BIRDS, LLC, it's affiliates and/or partners cannot be held liable for any unweaned bird/s that the buyer has chosen to purchase & take in his/her possession. By signing this agreement you are acknowledging and further stating that you are an experienced hand feeder and assume all responsibilities as to the health and well being of the un weaned bird/s. All adult birds and/or Breeder birds  & unweaned bird/s are sold without warranty/guarantee of any kind and are hereby noted to be sold on an AS IS basis, Oasis Exotic Birds, LLC provides NO warranty and/or guarantee either written or implied on above mentioned birds.

12. By purchasing a Bird(s) from OASIS EXOTIC BIRDS, LLC you are hereby acknowledging that you have read the contract above & are fully aware and understand it as well as the state laws both in Illinois & the state in which you reside governing the purchase, transportation and possession of the species of bird purchased and that under no circumstances will Oasis Exotic Birds, LLC. be held liable or accountable. By accessing or using this website or ordering a bird/s by phone or by appearing in person to purchase a bird directly from our retail location, you agree to our terms of use, policies, conditions and all applicable laws.  If you do not agree to these terms you may not use this website or purchase a bird/s from OASIS EXOTIC BIRDS, LLC.
