OASIS AVIARY PURCHASE AGREEMENT
(Please read the following agreement, fill in the Electronic Purchase Agreement Form, click SUBMIT FORM. Also, a 'hard copy' of this exact agreement will be mailed to you upon purchase for you to Sign, date and return in Postage Paid envelope. Please make a photocopy for your records. Birds will not be released until form has been signed & received by Oasis Aviary.)

2. This sales agreement and deposit/or full purchase price receipt is acknowledged and affirmed as being a complete description of the terms and conditions of sale concerning the following bird(s):

You are acknowledging that you have read, fully understand & accept this contract & OASIS AVIARY POLICY (located on our website @ www.petbedsandalotmore.com /www.oasisaviary.com YES ______(initials)
By signing this contract you are also acknowledging your complete agreement & understanding that ALL BIRD SALES ARE FINAL. A written Guarantee is given with each bird and is stated in it's entirety on the website. There are no refunds only bird exchange in the below detailed paragraph, subject to verified Avian veterinarian documentation & aviary management approval.

4. The birds identified at #2 shall be delivered to BUYER at time of weaning or if still being hand-fed, weaning date to be determined by aviary manager. BUYER agrees that he/she is solely responsible for all costs associated with said delivery, Designated Delivery Location charge is $25, or free delivery if picking up at an OFF-SITE location in Millstadt, IL. Or air cargo charges charges associated therewith, will be paid by BUYER (Delta $150/Contin. $250 or $50 USPS EXPRESS-$75 for certain states. If BUYER is unable to take delivery of the bird at the time herein referenced, then SELLER, at his/her sole discretion, may either consider the BUYER's order canceled, and retain any payments made and sell the bird to the next available customer or may renegotiate a delivery time with the BUYER for the bird, this is at OASIS AVIARY's sole discretion.
5. SELLER warrants that, at the time of delivery, the birds herein referenced are in good health, free of Congenital Defect/serious birth defects. BUYER is encouraged to have the birds examined by a veterinarian of his/her choice within seventy-two (72) hours from the time of delivery to verify the health of the birds. If, during this 72 hour period, the birds are found to have a serious life threatening congenital birth defect determined by the examining AVIAN Veterinarian, then upon verification of this condition to SELLER (detailed by Certified Avian Veterinarians examination or post mortem exam, instructions described in it's entirety on website see: OASIS AVIARY POLICY page) and upon return of the bird(s) by BUYER to SELLER, (at the buyers expense) SELLER agrees, at his/her sole discretion, to either refund the entire purchase price to BUYER as herein referenced (deposit excluded) OR to provide the BUYER with another bird or birds of the same species, sex (if applicable),currently available bird or from a future clutch. Costs of return and re-delivery transportation to be borne by SELLER (airfare/shpg not included) It is hereby understood that, prior to receipt of another bird under this paragraph, BUYER and SELLER shall execute a new Sales Agreement and Deposit Receipt referencing the new bird prior to its delivery to BUYER.
6. In the event BUYER fails to have the birds herein referenced examined by a veterinarian within seventy-two (72) hours after delivery, then BUYER understands and agrees that the sale is one of as is condition. There will be no warranty/guarantee either written or implied. BUYER understands and agrees that seventy-two (72) hours after delivery of the birds to BUYER, all warranties of health, fitness, merchantability and personality trait and pet potential, whether express or implied by law, are hereby expressly and voluntarily waived by BUYER. All risk as to the quality and/or performance of the birds referenced herein is with the BUYER and BUYER assumes all risk and cost of injury, death and treatment for the birds once said bird/s is in the BUYER'S possession. OASIS AVIARY & it's partners assume NO liability for the bird once possession of the bird has been completed by Buyer.
7. In the event SELLER is unable or unwilling to deliver the birds to BUYER for any reason at the time so identified in #4, then SELLER agrees to refund money paid (except deposit), to BUYER within 7-14 business days of SELLER's decision to not deliver the birds. We reserve the right to refuse to sell any bird to any individual, for any reason.
8. Regardless of the conditions and circumstances surrounding the negotiation of this Sales Agreement and Deposit Receipt, BUYER and SELLER agree that the interpretation and enforcement of this Agreement shall be governed by the laws of the State of Illinois in which state OASIS AVIARY resides and any suit instituted by BUYER or SELLER to enforce any term, condition or clause of this Agreement shall be filed in the appropriate Court in the County of St. Clair, in the State of Illinois.
9. In the event that either party hereto must file suit, as referenced in paragraph #8, to enforce the terms of this Agreement, it is agreed that the prevailing party shall recover all costs, including attorney's fees, associated with said enforcement from the losing party.
10. This Agreement has been read and understood by both parties hereto, and by executing the Agreement, with signatures, of both the Buyer & the Seller, both parties agree that all terms and conditions contained herein are acceptable and legally binding.
11.OASIS AVIARY will not be held liable for any unweaned babies that the buyer has chosen to take in his/her possession. By signing this agreement you are acknowledging and further stating that you are an experienced hand feeder and assume all responsibilities as to the health and well being of the unweaned bird/s. All adult birds and/or Breeder birds are sold without warranty/guarantee of any kind and are hereby noted to be sold on an AS IS basis, Oasis Aviary will give no warranty/guarantee either written or implied on such birds.

12. By purchasing a Bird(s) from OASIS AVIARY you are acknowledging that you have read the contract above & are fully aware and understand it as well as the state laws both in Illinois & the state in which you reside governing the purchase, transportation and possession of the species of bird purchased and that under no circumstances will Oasis Aviary be held liable. By accessing or using this Site, you agree to our terms of use, policies, conditions and all applicable laws. If you do not agree to these terms you may not use this Site
